These Terms of Service ("Terms") are a legal agreement between you and QuikFliks LLC ("QuikFliks," "we," "us," or "our") governing your use of the QuikFliks mobile application and quikfliks.tv (together, the "Service"). By creating an account or using the Service, you agree to these Terms.

§ 01

Acceptance of terms

By downloading, installing, accessing, or using the Service, you agree to be bound by these Terms and our Privacy Policy, which is incorporated by reference. If you do not agree, do not use the Service.

§ 02

Eligibility

You must be at least 13 years old to create an account. If you are under 18, you may only use the Service with the involvement and consent of a parent or legal guardian. By using the Service, you represent that you meet these requirements and that use of the Service is not prohibited by the laws of your jurisdiction.

§ 03

The service

QuikFliks is a micro-episodic vertical drama streaming app. Episodes are made available either (a) free, supported by advertising, subject to daily view limits, or (b) by unlocking with Coins, our in-app virtual currency. We may add, modify, or discontinue series, episodes, features, or unlock mechanics at any time.

§ 04

Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
You must provide accurate information and promptly update it if it changes.
You may not share, sell, or transfer your account, or create an account for anyone other than yourself.
We may suspend or terminate accounts that violate these Terms, as described in Termination.

§ 05

Virtual currency ("Coins")

Coins are a limited, revocable, non-transferable license to unlock episodes within the Service — not currency, property, or a store of value.
Coins have no cash value and cannot be redeemed, exchanged, sold, or transferred for real money or anything of value outside the Service, except where required by law.
Coins may be earned (e.g., through ad-gated unlocks) or purchased. We may set, and change, the number of Coins required to unlock an episode.
Coins are non-refundable except where required by applicable law or as described in Apple App Store terms / Google Play terms below.
We may limit, suspend, or cancel Coins in cases of suspected fraud, chargebacks, or violation of these Terms.
Unused Coins have no guaranteed shelf life beyond your active use of the Service and do not survive account termination for cause.

§ 06

Purchases & billing

All purchases of Coins are billed through Apple's App Store or Google Play Billing, depending on your device. Pricing, currency, tax, payment method, and refund handling for those purchases are governed by Apple's or Google's own terms and payment systems, not by QuikFliks directly. Subscriptions, if offered, will clearly disclose price, billing frequency, and cancellation instructions before purchase, and can be managed or cancelled through your Apple ID or Google Play account settings.

§ 07

Content license

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to stream and view QuikFliks content for personal, non-commercial entertainment purposes only. You may not download (except through in-app caching for offline playback where we explicitly enable it), copy, reproduce, distribute, publicly perform, publicly display, sell, rent, sublicense, or create derivative works from any content, in whole or in part, without our prior written consent.

§ 08

User conduct

You agree not to:

Circumvent, disable, or interfere with security-related features of the Service, including Coin/unlock mechanics or DRM.
Use bots, scrapers, or automated means to access the Service or extract content.
Reverse engineer, decompile, or disassemble the app except as permitted by law.
Use the Service for any unlawful, fraudulent, or abusive purpose, including chargeback fraud.
Upload or transmit viruses, malware, or other harmful code.
Impersonate any person or entity, or misrepresent your affiliation with anyone.
Harass, threaten, or abuse other users or QuikFliks staff, including in any in-app feedback or support channel.

§ 09

Intellectual property

The Service, including all series, episodes, scripts, characters, artwork, the QuikFliks name and logo, and underlying software, is owned by QuikFliks or its licensors and is protected by copyright, trademark, and other intellectual property laws. Nothing in these Terms transfers any ownership rights to you.

§ 10

Advertising

The free tier of the Service is supported by advertising served through Google AdMob and other ad partners we may engage. Ads may be shown before, during, or between episodes, and may be required to earn free unlocks. See our Privacy Policy for details on ad-related data practices.

§ 11

Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access to the Service, with or without notice, if we reasonably believe you have violated these Terms, engaged in fraudulent activity, or if required by law. Sections that by their nature should survive termination — including Intellectual Property, Disclaimer of Warranties, Limitation of Liability, and Indemnification — will survive.

§ 12

Disclaimer of warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

§ 13

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, QUIKFLIKS AND ITS OFFICERS, EMPLOYEES, AND LICENSORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, REVENUE, OR PROFITS, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM, OR (B) $50 USD.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

§ 14

Indemnification

You agree to indemnify and hold harmless QuikFliks and its officers, employees, and licensors from any claims, damages, losses, and expenses (including reasonable attorneys' fees) arising from your violation of these Terms or your misuse of the Service.

§ 15

Governing law & disputes

These Terms are governed by the laws of the State of California, without regard to its conflict-of-law principles, except where a specific platform's mandatory terms (see § 16 / § 17) require otherwise. Any dispute arising from these Terms or the Service will be resolved through binding individual arbitration in accordance with the rules of the American Arbitration Association, and you waive any right to participate in a class action, except where prohibited by law or where you validly opt out of arbitration as permitted below. Either party may bring an individual claim in small claims court instead of arbitration where eligible.

§ 16

Apple App Store terms

If you downloaded the app from the Apple App Store, the following additional terms apply and take precedence over any conflicting term above, as required by Apple:

This agreement is between you and QuikFliks only, not Apple, and Apple is not responsible for the Service or its content.
The license granted to you is limited to a non-transferable license to use the app on Apple-branded products that you own or control, as permitted by the App Store's Usage Rules.
Apple has no obligation to furnish any maintenance or support services for the app.
In the event of any failure of the app to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any, for the app; to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app.
QuikFliks, not Apple, is responsible for addressing any claims relating to the app, including product liability claims, claims that the app fails to conform to legal or regulatory requirements, and claims arising under consumer protection or similar legislation.
QuikFliks, not Apple, is responsible for the investigation, defense, settlement, and discharge of any claim that the app or your possession/use of it infringes a third party's intellectual property rights.
You represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties.
You must comply with any applicable third-party agreement (e.g., your wireless data service agreement) when using the app.
Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance, Apple has the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.

§ 17

Google Play terms

If you downloaded the app from Google Play, the following additional terms apply:

Purchases of Coins and any subscriptions are processed through Google Play's in-app billing system and are subject to the Google Play Terms of Service.
Refunds for Google Play purchases are handled according to Google Play's refund policies; QuikFliks will honor refund decisions made through Google Play.
Your use of the app must also comply with Google Play's Developer Distribution Agreement and applicable Google Play policies.

§ 18

Changes to these terms

We may modify these Terms from time to time. If we make material changes, we will notify you in-app or by email before the change takes effect. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
